Several Opinions of the General Office of the State Council on Implementing the Administrative Law Enforcement Responsibility System

The administrative law enforcement responsibility system is an important system to standardize and supervise administrative and law enforcement activities of administrative organs. In order to implement relevant regulations of "Outlines for Promoting Law-based Administration in an All-round Way" (State Council Release [2004] No. 10, hereafter referred to as "Outlines") and foster the establishment of an administrative law enforcement system featuring distinct responsibilities, standardized behaviors, effective surveillance and strong supports, as well as to promote law-based administration in an all-round way, upon approval the State Council, we are hereby presenting the following opinions on implementing the administrative law enforcement system:

1. Fully recognize the importance of implementing the administrative law enforcement system

The Central Committee of CPC and the State Council attach good importance to the implementation of the administrative law enforcement responsibility system. Distinct requirements have been laid on the implementation of the administrative law enforcement responsibility system in the 15th & the 16th National Congress of CPC and the Third & the Fourth Plenary Session of the 16th CPC Central Committee, and detailed provisions have been given on related works in "Decision of The State Council on Promoting Law-based Administration in an All-round Way" and "Outlines". For a number of years, all regions and departments concerned have been earnestly implementing requirements of the Central Committee of CPC and State Council and actively implement the administrative law enforcement responsibility system. They have carried out good efforts and made certain achievements in strengthening administrative law enforcement management and standardizing administrative law enforcement behaviors. However, there are still some problems in works: principals of some regions and departments do not have a good understanding and do not attach importance to this work; the administrative law enforcement system and related procedures are not yet sound; the appraisal and evaluation mechanism is not scientific.
