| Chapter I General Provisions
Article 1 This Law is formulated according to the Constitution of the People's Republic of China with a view to regularizing the management of civil servants, protecting lawful rights and interests of civil servants, and strengthening the supervision over civil servants, so as to build a contingent of high-caliber civil servants, keep government functionaries honest and industrious, and improve work efficiency.
Article 2 Civil Servants as mentioned in this Law shall refer to staff members who carry out public services according to the law and are included in state administrative establishments and whose salaries and welfare are bore by the national finance.
Article 3 This Law shall apply to obligations, rights and management of civil servants.
If there are special provisions in other laws concerning the election, appointment, dismissal and supervision of officials of civil servants, as well as provisions concerning obligations, rights and management of the judge and the attorney, those provisions shall apply.
Article 4 The system of the civil servants must take Marxism-Leninism, Mao Zedong Thought and Deng Xiaoping Theory and the important thought of Three Represents as guides to actions, and fully implement the basic line for the primary stage of socialism, the cadre line and the guideline of the Communist Party of China and the principle of cadre management under the Party.
Article 5 The principle of open, fair, competition and competitive selection should be followed in the management of civil servants, which must be carried out in accordance with statutory rights, conditions, standards and procedures.
Article 6 The principle of laying equal stress on supervision & restraint and encouragement & protection should be adhered to in the management of civil servants.
Article 7 The principle of appointing people with abilities and equipped with ethics & talents should be followed in appointing civil servants, whose work performance must also be paid attention to.
Article 8 The state will implement systematic management on civil servants in order to improve management efficiency and the level of scientific management.
Article 9 Civil servants' behaviors to perform duties in accordance with the law shall be protected by law.
Article 10 The central civil servant management department will be in charge of integrated management of civil servants throughout the country, while local civil servant management departments of all levels beyond the county level shall be in charge of integrated management of civil servants within their administrative areas. The higher level civil servant management department shall guide the management work of the lower level civil servant management department, while civil servant management departments of all levels shall guide the civil servant management work of organs of the same level.
